Driver arrested in fatal Key Biscayne accident

Tragedy struck early on the morning Wednesday, January 21, when a driver struck two bicyclists who were traveling along the eastbound lanes of Crandon Boulevard near Crandon Park Marina. One of the bicyclists, Walter Reyes, died on the scene. The second bicyclist, Henry Hernandez, remains hospitalized in serious, but stable condition.

According to police detectives, the person who struck the drivers was Alejando Alvarez. He originally fled the scene of the accident, but returned shortly after. Alvarez reportedly admitted that he was driving to his home on Key Biscayne after leaving a Miami Beach nightclub. He allegedly looked at his iPhone to change a song, but when he removed his sight from the road, he hit the cyclists. Alvarez also claims that he had not ben drinking.

Upon arrest, Alvarez was charged with leaving the scene of a deadly crash, DUI manslaughter, and serious bodily injury to another driver. He posted $38,500 in bond on Thursday morning. It is has not been said if Alvarez has hired an attorney.

Although Alvarez faces extremely serious charges, a criminal defense attorney can help him protect his rights during the trial process. For example, an attorney can determine whether a police officer or other involved party, violated any of Alvarez's constitutional rights at any point during the arrest. This can include unlawful searches, warrantless blood testing, and improper acquisition of confessions or statements.
