Top Texas Prosecutor Indicted on Felony Security Fraud Charges

Amid allegations of felony-level financial misconduct, Texas Attorney General Ken Paxton and his attorneys are fighting back against the courts.

Alleged Securities Fraud

Paxton was indicted on felony security fraud charges this summer and was indicted by a grand jury in his hometown of McKinney Texas. Paxton has asked a judge to throw out his case on the grounds that both the investigation and grand jury proceedings were flawed.

The allegations center around a tech startup called Severgy, Inc. Paxton is charged with defrauding well-heeled investors to the tune of $100,000, by persuading them to invest in the company without revealing that Paxton was on Severgy’s payroll. One of the investors was a Texas lawmaker. If accused, Paxton could face anywhere from 5 to 99 years in prison.

Attorney General and Defense Team Fire Back

Paxton’s accusations claim that the confidentiality of the grand jury investigation was compromised because the judge discussed the case with his wife and also that jury selection was improperly handled. Paxton’s team of attorneys also argue that the Texas State Securities Board did not refer criminal allegations against their client to the court. Paxton’s attorneys also point out one of the lesser charges brought against their client is beyond the statute of limitations.

Standing His Ground

Paxton is not stepping down from his position as Attorney General while the proceedings are underway, though he has recused himself from areas of his work that handle financial regulations.
